Durante 15 a\u00f1os la naci\u00f3n no recibi\u00f3 un solo centavo por la explotaci\u00f3n de un bien propiedad de la Naci\u00f3n<\/li>\n<\/ul>\n\n\n\nNunca el Gobierno del Estado de M\u00e9xico obtuvo concesi\u00f3n federal para poder disponer del dominio de una v\u00eda de comunicaci\u00f3n federal, propiedad de la Naci\u00f3n, sentenci\u00f3 la Fiscal\u00eda General de la Rep\u00fablica <\/p>\n\n\n\n
La concesi\u00f3n que el Estado de M\u00e9xico dtorg\u00f3 a la empresa Viaducto Bicentenario, S. A. de C. V., en el a\u00f1o de 2008 fue absolutamente ilegal y, por lo tanto, nula; cometi\u00e9ndose el delito de Explotaci\u00f3n de un bien de la Naci\u00f3n, sancionado en los art\u00edculos 149, 150 y 151 de la Ley General de Bienes Nacionales.<\/p>\n\n\n\n
Ese acto delictivo le permiti\u00f3 a un particular, el saqueo de m\u00e1s de 8 mil millones de pesos por dicha explotaci\u00f3n ilegal, correspondi\u00e9ndole el 99.5% de los ingresos totales, de esa v\u00eda federal; compartiendo con el Gobierno del Estado de M\u00e9xico 42 millones de pesos, equivalente al 0.5%; sin que la Federaci\u00f3n haya recibido, en estos quince a\u00f1os, ni un solo centavo por la explotaci\u00f3n de un bien propiedad de la Naci\u00f3n.<\/p>\n\n\n\n
Desde agosto de 2011, y nuevamente en marzo de 2020, la hoy Secretar\u00eda de Infraestructura, Comunicaciones y Transportes (antes Secretar\u00eda de Comunicaciones y Transportes) se\u00f1al\u00f3 esta ilegalidad y la presunci\u00f3n del delito federal correspondiente.<\/p>\n\n\n\n
Este no es un caso administrativo, ni civil; ya que est\u00e1 penado espec\u00edficamente como delito, independientemente de toda la serie de actos y convenios fraudulentos que se han venido realizando para encubrir dicho delito.<\/p>\n\n\n\n
El haber alegado, por parte del Estado de M\u00e9xico, que una autorizaci\u00f3n para el mantenimiento de una v\u00eda federal, como se da en todos los estados de la Rep\u00fablica, lo faculte para otorgar una concesi\u00f3n federal a un particular, es una absoluta falsedad y es contraria a derecho; ya que la \u00fanica autoridad facultada para otorgar una concesi\u00f3n de una v\u00eda general de comunicaci\u00f3n es la Secretar\u00eda de Infraestructura, Comunicaciones y Transportes.<\/p>\n\n\n\n
En la audiencia que acaba de llevarse a cabo, el grado de injusticia con el que actu\u00f3 el Juez Daniel Ram\u00edrez Pe\u00f1a lleg\u00f3 a un extremo verdaderamente inconcebible; ya que, antes de conocer las pruebas y argumentos de las partes, emiti\u00f3 p\u00fablicamente una opini\u00f3n respecto del caso y anunci\u00f3 su veredicto en contra del Estado Mexicano; raz\u00f3n por la cual la Representaci\u00f3n Social de la Federaci\u00f3n ah\u00ed mismo lo recus\u00f3 en audiencia, por incurrir en una causa de impedimento para seguir conociendo del asunto; y, por lo tanto, se le iniciar\u00e1 el juicio correspondiente, independientemente de los recursos que la ley permite.<\/p>\n\n\n\n
El art\u00edculo 150 de la Ley General de Bienes Nacionales define este delito: \u201c\u2026a quien use, aproveche o explote un bien que pertenece a la Naci\u00f3n, sin haber obtenido previamente concesi\u00f3n, permiso o autorizaci\u00f3n, o celebrado contrato con la autoridad competente\u201d. Y la \u00fanica autoridad competente en materia de bienes federales, en este caso, es la Secretar\u00eda de Infraestructura, Comunicaciones y Transportes\u201d, la cual no otorg\u00f3 concesi\u00f3n federal alguna. <\/p>\n\n\n\n
Para que exista una concesi\u00f3n federal debe cumplirse con los siguientes requisitos:
\u2022\u200bLas concesiones federales se otorgar\u00e1n mediante concurso p\u00fablico emitido por la autoridad competente federal (SICT).
\u2022\u200bLa concesi\u00f3n ser\u00e1 sobre un objeto que pueda ser materia del mismo (v\u00eda general de comunicaciones federal).
\u2022\u200bLa concesi\u00f3n deber\u00e1 cumplir con la finalidad del inter\u00e9s p\u00fablico regulado por las normas en que se concreta.
\u2022\u200bLa Secretar\u00eda de Infraestructura, Comunicaciones y Transportes emitir\u00e1 un fallo fundado y motivado.
\u2022\u200bSe se\u00f1alar\u00e1 el plazo de la concesi\u00f3n.
Todo esto nunca ocurri\u00f3.<\/p>\n\n\n\n
La Fiscal\u00eda General de la Rep\u00fablica iniciar\u00e1 de inmediato todos los recursos legales a que tiene derecho, frente a este nuevo atropello a la justicia y a la defensa de los bienes de la Naci\u00f3n.<\/p>\n","protected":false},"excerpt":{"rendered":"
