La LXII Legislatura mexiquense aval\u00f3 sancionar con hasta 10 a\u00f1os de prisi\u00f3n a las personas servidoras p\u00fablicas de procuraci\u00f3n y administraci\u00f3n de justicia que incurran en corrupci\u00f3n, omisiones, negligencia u obstrucci\u00f3n de investigaciones sobre delitos cometidos contra mujeres por razones de g\u00e9nero.<\/em><\/li>\n<\/ul>\n\n\n\nJuan Ignacio Corro<\/p>\n\n\n\n

La LXII Legislatura mexiquense aprob\u00f3 imponer hasta 10 a\u00f1os de prisi\u00f3n a las personas servidoras p\u00fablicas de procuraci\u00f3n y administraci\u00f3n de justicia que, obligadas a investigar o sancionar delitos cometidos contra mujeres por razones de g\u00e9nero, incurran en corrupci\u00f3n, omisiones, negligencia u obstrucci\u00f3n de la investigaci\u00f3n o la administraci\u00f3n de justicia, en perjuicio del derecho de las v\u00edctimas a la verdad, la justicia y la reparaci\u00f3n del da\u00f1o.<\/p>\n\n\n\n
El dictamen, le\u00eddo por la diputada Jennifer Nathalie Gonz\u00e1lez L\u00f3pez establece una pena de cuatro a 10 a\u00f1os de prisi\u00f3n, as\u00ed como sanciones de 100 a 150 d\u00edas multa y la destituci\u00f3n o inhabilitaci\u00f3n para el cargo por las conductas descritas.<\/p>\n\n\n\n
El documento, avalado por unanimidad en sesi\u00f3n deliberante del Congreso mexiquense, modifica el C\u00f3digo Penal y la Ley de Acceso de las Mujeres a una Vida Libre de Violencia, ambos estatales. En este \u00faltimo ordenamiento se precisa que corresponde a la Fiscal\u00eda General de Justicia del Estado de M\u00e9xico investigar, con perspectiva de g\u00e9nero y debida diligencia, todas las muertes violentas de mujeres y ni\u00f1as, bajo el protocolo del feminicidio.<\/p>\n\n\n\n
Cabe se\u00f1alar que el decreto retoma modificaciones planteadas por Irinea Buend\u00eda Cort\u00e9s, madre de Mariana Lima Buend\u00eda, v\u00edctima de feminicidio el 29 de junio de 2010 en Chimalhuac\u00e1n, para incorporar par\u00e1metros establecidos por la Suprema Corte de Justicia de la Naci\u00f3n (SCJN) en la sentencia del 25 de marzo de 2015 relacionada con el caso de su hija y el proceso judicial que inicialmente le neg\u00f3 justicia.<\/p>\n\n\n\n
Dicha sentencia permiti\u00f3 reabrir la investigaci\u00f3n sobre la muerte de Mariana Lima Buend\u00eda y orden\u00f3 realizar todas las diligencias necesarias con perspectiva de g\u00e9nero, a fin de determinar las circunstancias de su muerte y esclarecer si se trat\u00f3 o no de un feminicidio. El caso se convirti\u00f3 en un precedente hist\u00f3rico para la investigaci\u00f3n de las muertes violentas de mujeres en M\u00e9xico. Por este motivo, a la iniciativa se le denomin\u00f3 \u2018Mariana Lima Buend\u00eda\u2019.<\/p>\n\n\n\n
La legisladora Jennifer Nathalie Gonz\u00e1lez indic\u00f3 que la propuesta naci\u00f3 del dolor de muchas familias, madres, hijos y hermanos que han luchado y recorrido calles, instituciones e instancias por actos de injusticia, como el caso de Irinea Buend\u00eda, a quien agradeci\u00f3, al igual que a colectivos y personas defensoras jur\u00eddicas, por su participaci\u00f3n para establecer que la justicia no dependa de una interpretaci\u00f3n aislada, sino que se garantice en el marco legal.<\/p>\n\n\n\n
En este sentido, subray\u00f3 que la reforma no es \u00fanicamente punitiva, pues impulsa un cambio cultural y administrativo de justicia, lo cual asegura que todas las muertes violentas de mujeres no sean minimizadas. Expres\u00f3 que present\u00f3 el dictamen ante el Pleno legislativo con un profundo sentido de justicia, honor, responsabilidad y, sobre todo, de dignidad.<\/p>\n\n\n\n
Cabe precisar que el C\u00f3digo Penal estatal vigente establece penas de 40 a 70 a\u00f1os de prisi\u00f3n por feminicidio y transfeminicidio, adem\u00e1s de multas de 700 a 5 mil d\u00edas, las cuales pueden incrementarse en una tercera parte por diversas agravantes.<\/p>\n\n\n\n
