{"id":10574,"date":"2025-08-29T16:12:51","date_gmt":"2025-08-29T22:12:51","guid":{"rendered":"https:\/\/agencia.252.com.mx\/home\/?p=10574"},"modified":"2025-08-29T16:35:36","modified_gmt":"2025-08-29T22:35:36","slug":"gppan-plantea-que-el-mp-restituya-la-custodia-de-menores-a-madres","status":"publish","type":"post","link":"https:\/\/agencia.252.com.mx\/home\/gppan-plantea-que-el-mp-restituya-la-custodia-de-menores-a-madres\/","title":{"rendered":"Plantea PAN Edomex en Congreso, que el MP restituya la custodia de menores a madres"},"content":{"rendered":"\n<ul class=\"wp-block-list\">\n<li><em>PAN propone que el Ministerio P\u00fablico (MP) pueda devolver a la madre al ni\u00f1o o la ni\u00f1a de hasta tres a\u00f1os que haya sido sustra\u00eddo por el padre de su cuidado, sin la existencia de un juicio de guarda y custodia de por medio<\/em><\/li>\n\n\n\n<li><em>La iniciativa justifica esta medida dado que, a esta edad, a\u00fan se encuentran en etapa lactante<\/em><\/li>\n\n\n\n<li><em>A\u00f1ade que el MP debe informar de esta medida a una persona juez de lo familiar, quien deber\u00e1 ratificarla o modificarla<\/em><\/li>\n<\/ul>\n\n\n\n<p>&nbsp;Juan Ignacio Corro&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-right\">Toluca, Estado de M\u00e9xico, a 29 de agosto de 2025<\/p>\n\n\n\n<p>La diputada Emma Laura \u00c1lvarez Villavicencio y el diputado Pablo Fern\u00e1ndez de Cevallos Gonz\u00e1lez, del Grupo Parlamentario del PAN (GPPAN), plantearon en la LXII Legislatura mexiquense una iniciativa para facultar al Ministerio P\u00fablico (MP) de la entidad a devolver a la madre al ni\u00f1o o ni\u00f1a de hasta tres a\u00f1os de edad que haya sido sustra\u00eddo de su cuidado por el padre, sin la existencia de un juicio de guarda y custodia de por medio, bas\u00e1ndose en que a\u00fan se encuentran en etapa lactante.<\/p>\n\n\n\n<p>La iniciativa para reformar el C\u00f3digo Penal estatal, a la que dio lectura la diputada \u00c1lvarez Villavicencio, justifica esta medida dado que la lactancia materna es un pilar fundamental para el desarrollo saludable de las y los beb\u00e9s y el bienestar de las madres, ya que aporta m\u00faltiples beneficios a nivel nutricional, inmunol\u00f3gico y emocional.<\/p>\n\n\n\n<p>Para dictar la restituci\u00f3n del o de la menor al cuidado materno, el MP deber\u00e1 verificar que no exista una resoluci\u00f3n judicial previa sobre la guarda y custodia; determinar que se encuentra en etapa lactante y que la madre ha ejercido previamente su cuidado; evaluar que la restituci\u00f3n no represente un riesgo para su seguridad o bienestar; e informar a una persona juez de lo familiar \u2014dentro de las siguientes 24 horas\u2014 para la ratificaci\u00f3n o modificaci\u00f3n de la medida.<\/p>\n\n\n\n<p>Cabe se\u00f1alar que, seg\u00fan el C\u00f3digo Penal actual, cualquier persona (padre, madre o familiar) que se apodere de un hijo o hija menor de edad, sin tener la patria potestad o la custodia, enfrentar\u00e1 penas de prisi\u00f3n de uno a cinco a\u00f1os y multas de 40 a 125 d\u00edas multa.<\/p>\n\n\n\n<p>Finalmente, se se\u00f1ala que la separaci\u00f3n del beb\u00e9 de su madre puede vulnerar el desarrollo del apego, el cual es uno de los primeros v\u00ednculos afectivos que se establecen entre el ni\u00f1o o ni\u00f1a y su madre, padre o persona cuidadora.
